HHSC and DFPS agency reorganization

In 2017, the 85th Texas Legislature passed legislation that made significant changes to the Department of Family and Protective Services (DFPS), including making DFPS a stand alone agency that reports directly to the Governor.  DFPS was previously an umbrella agency under the Health and Human Services Commission (HHSC). 

Key provisions

  • DFPS becomes an independent agency
  • DFPS continues to work with HHSC for certain functions including Medicaid and STAR Health
  • Child Care Licensing regulatory functions were transferred to HHSC on September 1, 2017
  • A new consolidated Investigations division was created at DFPS that is now responsible for Special Investigations, and Child Protective Services and Child Care Licensing investigations
